1. General

These Terms & Conditions (“Terms”) govern all orders placed by you (“Customer”, “you”) with MODA Organise MichaÅ‚ Franas via our website or mobile site (www.modaorganise.com).

Please read these Terms carefully before placing an order. Using the store and placing orders requires acceptance of these Terms.

Product availability can change at any time; we may discontinue products without notice.

Customers provide personal data when registering or purchasing and consent to its processing in line with our Privacy Policy.

You may shop:

  • with a Customer Account (where we store your details and order history), or

  • as a guest.

You can terminate your Customer Account at any time (request deletion via e-mail or directly in the account settings).

You’re responsible for providing accurate data and for safeguarding your login details. We may cancel an order if data appears false or unverifiable (we’ll try to contact you first). If an email address used for your account changes or is deleted, please update it in your account.

We may suspend access or close accounts that violate these Terms or disrupt our services.

Use of the store is not permitted for persons under 18 (or the age of majority in your country).

 

2. Prices & delivery charges

Prices shown on modaorganise.com for deliveries within the EU include applicable VAT.
Prices exclude shipping. Delivery costs are shown at checkout.

For deliveries outside the EU, local import duties/taxes/fees (if any) are charged by your local customs and are not included unless we explicitly offer a DDP option at checkout.

Free-shipping thresholds (if offered) apply to the order subtotal and exclude duties/taxes for non-EU destinations.

Incoterms may vary by destination (DDP/DDU will be indicated at checkout).

 

3. Ordering & conclusion of contract

Orders can be placed via [modaorganise.com]. After placing an order you’ll receive an order confirmation email.
If we cannot fulfill your order, we’ll notify you and issue a refund using the original payment method (or another method if you expressly agree and it involves no cost to you).

 

4. Pre-orders (if/when offered)

  • We may offer pre-orders / waiting lists for upcoming products.

  • By placing a pre-order you accept these Terms and the specific pre-order conditions shown at checkout.

  • Contact details must be accurate and kept up to date.

  • Full payment (and any shipping fee) is taken at the time of pre-order.

  • Estimated launch/ship dates may change. We’ll keep you informed; we’re not liable for reasonable changes to such dates.

  • Pre-orders ship as soon as available.

 

5. Delivery

We exercise due care to process and deliver orders in line with the delivery option you select and no later than 30 days after payment.

Once shipped, you’ll receive tracking details. You’re responsible for accepting delivery once dispatched.
If you refuse delivery or fail to pay destination duties/taxes (where applicable), return costs (including duties advanced by the carrier and return transport) may be deducted from your refund.

  • DPD or DHL (door delivery)

6. Customs duties & taxes

  • EU deliveries: VAT is included in website prices.

  • UK / USA / other non-EU: We may offer DDP (duties paid) or DDU (duties unpaid). The applicable method for your destination is shown at checkout.

  • Destinations not explicitly shown as DDP are treated as DDU (duties/taxes collected by local customs).

 

7. Returns

You may return items within 14 days of receiving your order (including sale items). Items must be unused, unwashed, with all tags attached.
We do not offer exchanges on returns; return for a refund, then place a new order for a different size/color.

  • Original shipping charges, duties and taxes are non-refundable (except where required by law).

  • International customers: return using any tracked service at your own cost (unless local law requires otherwise).

  • Keep proof of posting; the parcel remains your responsibility until received.

Defective items: Notify us promptly and return the item. If we confirm a defect, we’ll replace or refund you (including reasonable return shipping).

Refund timing: We process refunds to the original payment method within 14 working days of receiving your return (or earlier upon receiving proof of dispatch), unless you expressly agree to another no-cost method.

 

8. Payment methods

We generally accept: credit/debit cards (Visa/Mastercard), BLIK, Apple Pay, Google Pay, Przelewy24.
We may restrict certain methods for specific orders/destinations.

Card payments: the amount may be reserved on your card at order placement and charged upon dispatch. Any bank fees are borne by you.

 

9. Our liability

Our maximum aggregate liability related to your order is limited to the total price of that order, except where such limitation is not permitted by applicable law.

10. EU consumer rights — right of withdrawal & lack of conformity

Right of withdrawal (EU):
You have 14 days from delivery to withdraw from the contract without giving reasons. To exercise this right, send us a clear statement (email or letter). You may use our model withdrawal form, but it’s not mandatory. If submitted online, we’ll confirm receipt by email.

Effects:
We refund all payments received including standard delivery costs (excluding any extra cost for non-standard delivery you chose) within 14 days of receiving your withdrawal notice. We may withhold the refund until we receive the goods or proof of return. You must return items within 14 days of your notice. You are liable only for any diminished value resulting from handling beyond what is necessary to establish nature, characteristics and functioning.
For sealed goods unfit for return for health/hygiene reasons once unsealed, the right may expire prematurely.

Lack of conformity (EU):
Products are new and original. We are liable for any lack of conformity existing at delivery that becomes apparent within 2 years.
Consumers may request repair or replacement, or a proportionate price reduction or contract termination where conditions are met under applicable law. You may withhold payment of the outstanding price until we fulfil our obligations. Minor non-conformity does not entitle termination. Statutory provisions apply.

11. Guarantee

Where defects are present, statutory warranty rules apply. For obvious material/manufacturing faults (including transit damage), notify us without delay and return the goods using a tracked method.

12. Severability

If any provision of these Terms is found invalid or ineffective by a competent authority, the remaining provisions remain in full force.

13. Intellectual property

All intellectual property rights (including trademarks, logos, images, designs, text) on modaorganise.com are owned by MODA Organise Michał Franas or its licensors. Any use beyond personal, non-commercial browsing requires our prior written consent.

15. Governing law, disputes & changes to Terms

Polish law governs sales made via the store, without prejudice to mandatory consumer protections in your place of residence.

Courts: Disputes shall be submitted to the courts of Poland or the courts of your residence, if required by applicable law.

These Terms do not limit any mandatory consumer rights. If these Terms conflict with mandatory consumer law granting you broader rights, that law prevails.

We may amend these Terms for important reasons, including (a) compliance with law, (b) removing clauses adverse to Customers, (c) changes/expansion of our offer, (d) changes in our business profile, (e) organisational changes.

Changes do not affect orders placed before the effective date (unless required by mandatory law). We’ll notify Customers of changes by email (to the address used for the order/account) and by posting the new Terms on the website at least 14 days before they take effect. If you don’t accept the new Terms, you may terminate your Customer Account at any time by requesting account deletion.

If a court amends or invalidates any provision, the remainder stays in force.
